SC of Pakistan Begins Hearings on Article 63-A
The Supreme Court of Pakistan has commenced hearings on review appeals concerning the interpretation of Article 63-A.
A five-judge larger bench, led by Chief Justice Qazi Faez Isa, is overseeing the appeals, which also includes Justices Aminuddin Khan, Jamal Khan Mandokhail, Naeem Akhtar Afghan, and Mazhar Alam Miankhel.
During the initial proceedings, Shahzad Shaukat, the President of the Supreme Court Bar, addressed the bench, which noted that his arguments had already been completed.
The court received a report from the Registrar regarding the detailed judgment on Article 63-A, indicating that this judgment was issued on October 14, 2022.
Shaukat explained that the delay in filing the review petitions was due to waiting for the detailed judgment. In response, Justice Jamal Khan Mandokhail questioned whether the Supreme Court Bar was unaware of the deadlines for filing such petitions, contrasting this with the situation of an ordinary citizen.
It’s important to note that a new bench was formed yesterday after Justice Munib Akhtar opted out of the proceedings. The Judges Committee subsequently replaced Justice Akhtar with Justice Naeem Akhtar Afghan.
On Tuesday, Shahzad Shaukat provided arguments on behalf of the Supreme Court Bar. The federal government and the Pakistan Peoples Party (PPP) backed the review petitions, while PTI’s lawyer, Barrister Ali Zafar, raised objections regarding the composition of the bench.
