No Duplicate FIRs Allowed Outside Relevant Police Station: IHC

Islamabad: The Islamabad High Court has delivered a landmark judgment, clarifying that an FIR for an incident can only be registered at the police station where the incident occurred. This decision comes amid the ongoing legal battles involving former Interior Minister and Awami Muslim League chief Sheikh Rasheed.

Justice Tariq Mehmood Jahangiri issued a detailed 41-page decision on the applications related to cases filed against Sheikh Rasheed in Kemari Karachi and other locations. The court emphasized that constitutional courts have a duty to protect citizens’ rights, stating that the Islamabad Polyclinic incident falls within the jurisdiction of Islamabad’s police, thus dismissing the case filed at the Mojko Kemari Karachi Police Station.

The decision highlighted the misuse of legal processes by political entities, noting that frivolous cases are often made against political opponents. The judgment criticized the practice of filing identical charges in multiple jurisdictions, describing it as a clear violation of Supreme Court rulings and detrimental to democracy and the rule of law.

In the detailed decision, it was noted that judicial assistants and police officials agreed that the FIR for the incident in Islamabad could not be validated in other provinces. Consequently, the petitioners withdrew their applications.
The court’s decision referenced the Supreme Court’s ruling in the Minor Bibi case, which states that an incident cannot result in multiple FIRs in different locations.

The case in question involved Sheikh Rasheed allegedly making derogatory remarks about Bilawal Bhutto Zardari at Islamabad Polyclinic, leading to an FIR being registered in Kemari Karachi, which the court has now dismissed.
This ruling reaffirms the principle that legal actions must be confined to the appropriate jurisdiction, and discourages the practice of political harassment through the misuse of the legal system.
