SC Rules 40% NTS Marks Mandatory For PST Recruitment

ISLAMABAD: (Web Desk) – The Supreme Court of Pakistan on Saturday declared the Peshawar High Court verdict in the primary school teacher (PST) recruitment case null and void, affirming that candidates must secure at least 40 percent marks in the NTS test to be eligible.

Justice Shakeel Ahmad authored the decision, rejecting applications from candidates who failed to pass the eligibility test. The ruling emphasized that candidates cannot legally challenge recruitment criteria once they have applied.

The court noted that the Education Department Khyber Pakhtunkhwa policy of 2017 was valid and that courts do not have authority to interfere in policymaking. Justice Ahmad clarified that the Peshawar High Court’s observation questioning the provincial education minister’s directives was incorrect, stating that the minister has legal authority to set recruitment criteria under the rules of business.

Regarding previous trial court decisions, the apex court noted that lower courts erred by ordering that the names of unsuccessful candidates be included in the merit list. Instead of following the 2017 policy, they relied on the outdated 2014 policy, which had already been rejected.

The ruling effectively maintains the 40 percent NTS mark as a mandatory eligibility requirement and denies requests from unsuccessful candidates to have their names added to the recruitment merit list.
