Gandapur Criticizes Weak Judicial System and Calls for Legal Professionals to Uphold Merit

Peshawar-Khyber Pakhtunkhwa (KP) Chief Minister Ali Amin Gandapur has made it clear that he remains steadfast in his commitment to advocating for justice, rights, and genuine freedom. During a recent ceremony hosted by bar council associations, Gandapur emphasized his unwavering resolve to voice concerns and push for reforms despite the prevailing challenges.

In his address, Gandapur underscored the critical role of lawyers in ensuring justice for the general populace. He highlighted that nations make significant progress when justice prevails, and lamented the current state of the judicial system, which he described as weak. The Chief Minister stressed that it is the responsibility of legal professionals to uphold justice and merit, asserting that the advancement of society is hindered without the rule

Gandapur called on lawyers to resist defending cases that lack merit, emphasizing that progress is unattainable without adherence to legal principles and the rule of law. He attributed many of the challenges faced by Khyber Pakhtunkhwa to the actions of the ruling elite, suggesting that these difficulties are largely a result of poor governance.

The Chief Minister also expressed his views on media and journalism. He described journalists as his “brothers” and expressed that criticism from the media is acceptable. However, he voiced frustration over what he perceives as a lack of journalistic advocacy against corruption and for the supremacy of the Constitution. Gandapur pointed out that in the absence of a fair and equitable system of reward and punishment, the Constitution is frequently violated. He warned against operating under dual legal systems and standards, arguing that such discrepancies prevent progress and contribute to systemic injustice.

Addressing the issue of internal divisions and dissatisfaction within KP, Gandapur revealed his intention to personally engage with Afghanistan on certain matters. He suggested sending a delegation to Afghanistan but declared that he would take the matter into his own hands if necessary. His remarks were driven by a sense of frustration and a personal commitment to addressing issues that he feels are affecting the province and its governance.

The Chief Minister defended his right to speak out against perceived injustices and oppression by the ruling authorities, asserting that his actions are grounded in constitutional rights rather than incitement. He voiced concerns about the misuse of the National Accountability Bureau (NAB), stating that it was established for accountability rather than revenge. Gandapur recounted an instance where seven FIRs (First Information Reports) were filed against him in a single hour, which he viewed as an excessive and retaliatory measure.

Gandapur reaffirmed his status as a citizen of Pakistan with the right to express his views and demand accountability. He emphasized that if authorities fail to address his concerns, he will continue to speak out. His comments extended to broader concerns about accountability within the prison system, where he suggested that any jail superintendent who improperly transfers a detainee should be held accountable and required to explain their actions.

“Unfortunately, our judicial system is weak. Now, it is the duty of the lawyers to uphold justice and merit and play their significant role in promoting and protecting justice and rights.

“Don’t defend cases against merit. We cannot go forward without the rule of law.
“We are facing challenges in KP and all these difficulties have been created by the rulers.”

“Journalists are my brothers. If they speak against me, it is ok. When I say some journalists do not speak against corruption and for the superiority of the Constitution, they turn against me,” he said.

KP Chief Minister Ali Amin Gandapur’s speech highlighted his commitment to justice, transparency, and constitutional rights. He criticized the weaknesses in the judicial system, the dual legal standards in the country, and the misuse of accountability institutions. His remarks also reflected his determination to address internal and external challenges facing Khyber Pakhtunkhwa, advocating for a fair and just system while expressing frustration over the perceived lack of accountability and transparency in governance.
