LHC Bar moves SC against IHC judges’ transfer
The petition has requested the Supreme Court to suspend and review the transfers
ISLAMABAD (Web Desk) — The transfer of three judges from the Islamabad High Court has been challenged in the Supreme Court of Pakistan, with a petition seeking to declare the move unconstitutional.
According to details, the petition was filed by the Lahore High Court Bar Association through senior lawyer Hamid Khan, naming the federal government and the Judicial Commission of Pakistan as respondents.
The plea argues that the transfers violate Article 2A of the Constitution and alleges a lack of transparency in the process, stating that no formal reasons were provided for the judicial reshuffle.
The development comes after a notification issued following approval by Acting President Yousaf Raza Gilani on April 29. The Ministry of Law and Justice later formalized the transfers.

Under the decision, Justice Mohsin Akhtar Kayani has been transferred to the Lahore High Court, Justice Babar Sattar to the Peshawar High Court, and Justice Saman Rafat Imtiaz to the Sindh High Court.
The Judicial Commission of Pakistan, chaired by Chief Justice Yahya Afridi, had approved the transfers earlier. Reports indicate that nine members supported the decision while four opposed it, reflecting a split within the commission.
The petition has requested the Supreme Court to suspend and review the transfers, terming the process unconstitutional and procedurally flawed.
