Supreme Court Drama: Justice Munib Akhtar Fails to Attend Article 63-A Hearing
A tense situation arose in the Supreme Court of Pakistan on Monday as Justice Munib Akhtar failed to appear for the hearing of appeals concerning Article 63-A.
A five-member bench, presided over by Chief Justice Qazi Faez Isa, convened to address the appeals. The bench also included Justices Aminuddin Khan, Jamal Mandokhail, and Mazhar Alam.
Chief Justice Isa informed those present that Justice Munib had communicated his inability to attend the proceedings, leading to an adjournment of the session.
CJP Isa expressed hopes that the bench could persuade Justice Munib to participate in the proceedings scheduled for Tuesday.
The Supreme Court had originally set September 23rd as the date for reviewing the appeals on the interpretation of Article 63-A.
This matter follows the court’s earlier ruling on May 17, 2022, regarding a presidential reference related to Article 63-A, which determined that votes cast by members of parliament who defect from their party’s stance would not be counted. The ruling also specified that the length of disqualification for such members would be decided by parliament.
The decision, which resulted in a 3-2 split, was authored by then-Chief Justice Umar Ata Bandial, with dissenting opinions from Justices Mazhar Alam Miankhel and Jamal Khan Mandokhail. The majority opinion, drafted by Justice Munib Akhtar, has faced multiple review petitions that are still pending.
