Supreme Court Slams ECP’s Conduct in Latest Ruling

Pakistan’s Supreme Court has sounded the alarm on the Election Commission of Pakistan’s (ECP) conduct, citing serious concerns in its latest ruling. The ECP’s September 14 order, meant to clarify prior ambiguities, surprisingly positioned the ECP as a primary opposing party in ongoing legal disputes, sparking the court’s dismay.

The Supreme Court emphasized the ECP’s vital role in ensuring transparent and fair elections, positioning it as a safeguard of democracy and a cornerstone of governance. However, the ruling criticized the ECP for falling short of its duties, particularly in February 2024. The court stressed that the Pakistan Tehreek-e-Insaf (PTI), its candidates, and voters should not bear the brunt of Returning Officers’ and the ECP’s illegal actions.

The court’s criticism of the ECP’s behavior is multifaceted. Firstly, the ECP’s order of September 14 attempted to clarify previous ambiguities but instead raised more questions. Secondly, the ECP’s role as a primary opposing party in ongoing legal disputes undermines its neutrality and impartiality.

Moreover, the ECP’s failure to fulfill its responsibilities, particularly during the events of February 2024, has severe implications for the electoral process. The court’s emphasis on the PTI, its candidates, and voters not being held accountable for the illegal actions of Returning Officers and the Election Commission highlights the need for accountability within the ECP.
