Supreme Court Rejects Review Petition on PTI Intra-Party Elections
January 13 ruling upheld despite PTI's request for a larger bench
The Supreme Court of Pakistan has rejected a review petition challenging its January 13 ruling regarding the Pakistan Tehreek-e-Insaf (PTI) intra-party elections, affirming its original verdict.
The petition was heard by a special three-judge bench led by Chief Justice Qazi Faez Isa, with Justice Muhammad Ali Mazhar and Justice Munib Akhtar also on the panel. PTI had sought the formation of a larger bench to review the case.
PTI’s legal representative, Hamid Khan, argued that the case should be referred to the Judges Committee to form a larger bench, suggesting that the current three-judge panel was not appropriate for the matter, pointing to a prior decision involving a 13-judge bench in the Sunni Ittehad Council case.
Chief Justice Isa noted that this was a review petition, and the court’s focus was to interpret the law, emphasizing that such petitions typically question the legal basis of previous court rulings. He questioned why this issue had not been brought up earlier.
In response, Hamid Khan requested the court to specifically review a paragraph from the decisions in the Sunni Ittehad Council and Election Commission cases. However, the Chief Justice stated that the court would not reconsider those rulings, as they pertained to separate issues.
