SC Rejects Govt Plea for Military Courts to Handle Civilian Cases

ISLAMABAD: The Supreme Court‘s constitutional bench, led by Justice Aminuddin Khan, has rejected the government’s request to allow military courts to decide civilian cases. The court emphasized that granting such authority would validate military courts’ jurisdiction over civilian matters.

Justice Musarrat Hilali noted that permitting military courts to try civilians would imply formal recognition of their authority in such cases. Additionally, the court dismissed former justice Jawad S. Khawaja’s plea to delay the hearing until the 26th constitutional amendment is decided, imposing a Rs 20,000 fine on him.

Justice Jamal Mandokhail criticized the delay tactics, while Justice Muhammad Ali Mazhar expressed concern over recurrent delays. The court also addressed the case of detained lawyer Hassan Niazi, with his father confirming his support for proceeding with the trial. The hearing was adjourned until the next day for further deliberations.
