IHC Practice and Procedure Rules Must Be Published Online

ISLAMABAD: (Web Desk) – Justice Mohsin Akhtar Kayani of the Islamabad High Court has issued a major order directing that the High Court’s Practice and Procedure Rules be uploaded on the court’s official website within 48 hours. The court also instructed that copies of these rules be provided to the Islamabad High Court and all District Bar Associations.

The order was issued during the hearing of a petition filed by PTCL. During the proceedings, Justice Kayani inquired from the petitioner’s lawyer about the Practice and Procedure Rules. The lawyer stated that they were unaware of the rules’ details and had filed the petition to obtain them.

Justice Kayani remarked, “We created the High Court rules that even we don’t have. I am a judge, and I haven’t received them—how will you?”

He further observed that although the Full Court had approved the Practice and Procedure Rules, they had not been made public, effectively rendering them secret documents. Justice Kayani instructed the lawyer to submit a written request to the Registrar to provide the rules, noting that requests to the Ministry of Law often take months to process and documents at the Registrar’s office are not always promptly provided.

The court made it clear that the rules must be uploaded online within 48 hours, warning that failure to comply could result in criminal proceedings against the responsible officials, and the Registrar could be summoned.

The petitioner’s lawyer requested that the hearing be scheduled for January 29, but Justice Kayani responded that he was unsure if he would be available on that date. The court subsequently adjourned the case for further hearing.
