Judges Urge Supreme Court to Annul IHC’s Seniority List, Citing Constitutional Contradictions

ISLAMABAD: Islamabad High Court Bar Association has filed a petition challenging the judges’ seniority list in the Supreme Court of Pakistan.
Islamabad High Court Bar president filing the petition under Article 184(3) has urged the Supreme to declare that the President does not enjoy unlimited authority over the transfers of judges
The Bar has argued in the petition that judges cannot be transferred from one high court to another without public interest.
Five Islamabad High Court (IHC) judges have also challenged judicial transfers and their impact on seniority in the Supreme Court.

The 49-page constitutional petition, filed under Article 184(3), claims that the President misused Article 200(1) by bypassing the Judicial Commission’s authority in judge transfers.
The petition argues that Article 200 permits only temporary transfers, and the current process violates Article 175(A) of the Constitution.
The judges have requested the Supreme Court to annul the IHC’s seniority list, stating it contradicts Article 194 and the Third Schedule of the Constitution.
The petitioning judges include Justice Mohsin Akhtar Kayani, Justice Babar Sattar, Justice Tariq Mehmood Jahangiri, Justice Saman Rafat Imtiaz, and Justice Sardar Ejaz Ishaq Khan.
