ISLAMABAD – The Election Commission of Pakistan (ECP) on Tuesday disqualified former prime minister and Pakistan Tehreek-e-Insaf (PTI) chief for five years following his conviction in Toshakhana case.
A notification of disqualification has been issued by the electoral watchdog. The ECP also de-notified the PTI chief from the NA-45 Kurram.
An Islamabad court handed a three-year prison sentence and a fine of Rs100,000 to the PTI chief in Toshakhana case. This decision came during the hearing of the criminal complaint filed by the Election Commission of Pakistan (ECP) against the PTI chairman.

Later, the PTI chairman was arrested by Punjab police from his Zaman Park residence in Lahore on Aug 5.
In a notification issued today, the ECP said, “A person shall be disqualified from being elected or chosen as, and from being, a member of the Parliament if he has been, on conviction for any offence involving moral turpitude, sentenced to imprisonment for a term of not less than two years, unless a period of five years has elapsed since his release.”
The electoral watchdog declared the PTI chairman disqualified under Article 63(1)(h) of the Constitution read with Section 232 of the Elections Act, 2017.
Toshakhana case
The Toshakhana case, initiated by lawmakers of the ruling party, originated from a criminal complaint brought forward by the ECP.
The case asserted that the PTI chief had purposefully hidden details regarding gifts he retained from the Toshakhana – a repository where presents given to government officials by foreign dignitaries are stored – during his tenure as prime minister, along with proceeds from their reported sales.
In accordance with Toshakhana regulations, individuals subject to these rules are required to report gifts, presents, and similar items received to the Cabinet Division.
The former prime minister faced multiple legal challenges over his retention of these gifts, a matter that ultimately led to his disqualification by the ECP.

A decision to this effect was taken in a PTI Core Committee meeting held on Tuesday.
The emergent meeting was summoned by PTI vice chairman Shah Mahmood Qureshi over the arrest of Imran in a corruption case.
A notification issued by the party office after the meeting stated that after the approval of the unanimous resolution of the PTI Core Committee, the slot of PTI Chairman was allotted to its founder member Imran Khan for life.
The notification said that a legal framework for the release of Chairman Imran Khan was discussed along with the action plan for the future.
The PTI has given a nationwide call for peaceful protests against the ‘illegal’ arrest of its chairman Imran Khan.
The notification added that despite providing concrete evidence in the Toshakhana case, the biased judge gave a pre-planned verdict which the nation has rejected.
PTI workers and supporters condemn the illegal arrest of Imran Khan and must come out for peaceful protests all over the country to raise their voices against injustice, it held.
It read that in light of the special instructions sent by Chairman Imran Khan from jail, a decision has been taken to celebrate Pakistan’s Independence Day in a grand manner.
Pakistan Tehreek-e-Insaf will organize special events on the occasion of Independence Day in Pakistan and around the world, it said.
With the approval of Chairman Imran Khan, Tehreek-e-Insaaf also announced to challenge the decisions of the Council of Common Interests before the Supreme Court.
It further stated that the meeting agreed on strong legal and political resistance to every attempt to delay the elections.
It is decided in the meeting that the party would continue to insist on conducting the elections within the constitutional period of 90 days after the dissolution of the National Assembly. The party decided to challenge the amendments made in the Official Secrets Act in front of the Supreme Court for the protection of fundamental rights and personal freedoms.
Another decision was taken saying that the PTI will stop the process of making laws into bloodsuckers by the fascist government and will protect the rights and personal freedoms at all costs.
A decision was taken to vigorously resist every attempt in the future to deprive Tehreek-e-Insaf of the electoral symbol of “bat”.
The participants said that the election symbol of the “bat” is our right as a party, if there is a reprehensible attempt to destroy it, we will challenge it in all legal and political platforms.
