IHC Restores 10-Year Disqualification Period for NAB Graft Convicts

“According to NAB law, the disqualification will be for 10 years,” prosecutor tells court

Islamabad: In a recent development, the Islamabad High Court (IHC) has reinstated the 10-year disqualification period for individuals convicted of corruption by the National Accountability Bureau (NAB) under its accountability laws. The court’s division bench, comprising Justice Mohsin Akhtar Kayani and Justice Saman Rafat Imtiaz, took this decision, overturning the previous verdict issued by its single bench that had reduced the disqualification period to five years.

The IHC’s decision came during the hearing of a plea filed by NAB, challenging the reduction of the 10-year disqualification to five years for one of its convicts, Faiq Ali Jamali, a politician associated with the Pakistan Muslim League-Nawaz (PML-N). Senior Special Prosecutor NAB Muhammad Rafi informed the court about the Supreme Court upholding Jamali’s sentence, leading to the restoration of his 10-year disqualification.

The prosecutor highlighted that, according to NAB law, the disqualification period should be 10 years. NAB had approached the IHC seeking the suspension of its single bench decision and the restoration of the original 10-year disqualification for NAB convicts intending to participate in the February 8 general elections.

The court’s decision addresses concerns about the eligibility of individuals convicted under NAB laws to contest elections, reinforcing the original disqualification period specified by the anti-graft watchdog.
