IHC Refuses Immediate Suspension of CDA Dissolution, Accepts Intra-Court Appeal for Hearing

Appellant Challenges Relief, Affirms CDA’s Right to Levy Tax

Islamabad: The Islamabad High Court (IHC) has rejected a request for an immediate stay order on the decision to dissolve the Capital Development Authority (CDA), while accepting an intra-court appeal against the decision for formal hearing.

A division bench comprising Justice Khadim Hussain Samroo and Justice Azam Khan declined to suspend the earlier judgment by Justice Mohsin Akhtar Kayani regarding the dissolution of CDA. However, the court issued notices on various related petitions and sought responses from all parties involved.

During the hearing, the counsel for the appellant argued that the single bench granted relief beyond the scope of the original plea, asserting that the CDA has the legal authority to impose the Right of Way tax.

The court, while issuing notices on the appeal and related applications, adjourned further proceedings to a later date, directing all parties to submit their replies.
