Fawad Chaudhry’s arrest warrants issued by ECP in contempt case

Khan’s assistant lawyer argued that under the law of evidence, technology could be utilized to allow virtual attendance, and the court could permit it.

Islamabad: In a significant development, the Election Commission of Pakistan (ECP) has issued a bailable arrest warrant for former federal minister Fawad Chaudhry in the contempt of the Election Commission and Chief Election Commissioner case.

The case involves PTI founder Imran Khan and Fawad Chaudhry, with the latest hearing revealing that the Islamabad High Court (IHC) has not issued a stay order in favor of Imran Khan. The last hearing in this case at the IHC was in January, where the court prevented the final order but allowed proceedings to continue.

Imran Khan’s lawyer suggested that the ECP could ensure virtual attendance of the respondents. However, the ECP members questioned whether virtual attendance is permissible, noting that while it is not necessary in civil cases, it is mandatory in criminal cases.

Khan’s assistant lawyer argued that under the law of evidence, technology could be utilized to allow virtual attendance, and the court could permit it.

One ECP member pointed out that Fawad Chaudhry is not in jail, and thus, a warrant for his arrest could be issued. The assistant lawyer mentioned that Fawad Chaudhry’s case is currently ongoing in the IHC.

The ECP member clarified that Fawad Chaudhry’s presence in the IHC is not required. Following continuous absence, the ECP issued a bailable arrest warrant for the former federal minister and adjourned the hearing until August 7.

This move highlights the ongoing legal challenges faced by prominent PTI figures and underscores the ECP’s commitment to pursuing the case.
