Shakil Shaikh condemns PCB political inquiry

PCB imposes lifetime ban on Shakil Ahmed Shaikh.

Islamabad (Mudasser Chuhdary) In a series of tweets, former Member Board of Governors (BoG) of Pakistan Cricket Board (PCB) Shakil Shaikh announced a significant victory, declaring himself and Diamond Cricket Club (DCC) exonerated from baseless allegations. The tweets shed light on the details of a protracted legal battle that spanned four years.

The controversy began during Ehsan Mani’s tenure in October 2020, with PCB filing a suit against DCC and Shakil Shaikh on what Shaikh claims were frivolous grounds. Despite the extended legal proceedings, PCB failed to substantiate its case against the defendants. According to internal investigations within PCB, the case was internally examined and found to be frivolous and baseless.

Shaikh highlighted that the Civil Court of Islamabad dismissed PCB’s case in July 2023 when Zaka Ashraf led the PCB Management Committee. This dismissal, according to Shaikh, resulted in their exoneration from all baseless allegations. Notably, PCB has not challenged this court decision to date.

However, Shaikh raised concerns about a recent politically motivated inquiry initiated under Zaka Ashraf. This inquiry revisited the same allegations without affording Shaikh and others the opportunity to present their side, leading Shaikh to assert the illegality of the proceedings. Shaikh argued that the matter, once decided by a court of law, cannot be reopened, citing the principle of “Res Judicata.”

Shaikh further contended that the inquiry and its findings amounted to “double jeopardy,” emphasizing that a person cannot be tried twice for the same cause. He highlighted that the defendants were not provided with essential documents, making the ex-parte inquiry conducted without their knowledge questionable.

The tweets also delved into the details of a civil suit against DCC and Shakil Shaikh, which the inquiry report claimed was still pending. Shaikh clarified that the same civil suit was initially dismissed by PCB for non-prosecution and later by the civil judge in July 2023. PCB has not appealed against this dismissal order.

In light of these circumstances, Shakil Shaikh announced his intention to charge PCB, Zaka Ashraf, the Inquiry Committee, complainants, and those involved in running a malicious campaign with a legal notice. Shaikh asserted their legal rights and vowed to take appropriate legal action against those involved in what he deemed a frivolous complaint and politically motivated inquiry.

The tweets collectively presented a comprehensive narrative of the legal ordeal, emphasizing the exoneration of Shakil Shaikh and DCC, while challenging the legitimacy of the recent inquiry and signaling their intent to pursue legal avenues.

Ban on Shakil Ahmed Shaikh

Earlier, the Pakistan Cricket Board (PCB) has imposed a lifetime ban on former member of the Board of Governors (BoG) Shakil Ahmed Shaikh on charges of financial irregularities.

The action has been taken on the recommendations of the committee formed about five months back to probe the charges of financial irregularities.

At that time, Shakil Shaikh was also suspended and the management of Regional Cricket Association Islamabad was handed over to an ad-hoc committee headed by Muhammad Junaid Akhtar.

Shakil Shaikh has been barred from holding office of regional associations, cricket associations, clubs or any portfolio under the PCB in the future.
