Trump Admin Moves To End H-1B Visa Grace Period
Foreign workers could lose 60 days to find new jobs
Trump – (Special Correspondent/Web Desk) – The Trump administration wants to remove a rule that gives H-1B visa holders extra time to stay in the US after losing a job.
Right now, workers get 60 days to find a new sponsor. This grace period has helped thousands of skilled foreign employees since 2017.
Under the new plan, workers would have to leave the country as soon as their job ends. There would be no waiting period at all.
The US Department of Homeland Security shared this proposal in the Federal Register. The agency believes American workers could fill many of these open roles instead.
DHS also said that companies might choose to rehire the same foreign employee later. This would only happen if the employer files a fresh work petition.
H-1B visas were created in 1990. They mainly help tech companies hire skilled workers from countries like India and China.
Big firms such as Deloitte, PwC, EY, Tata Consultancy Services, Infosys, and HCLTech are some of the top sponsors of these visas.
Immigration lawyers say this change would create huge pressure on companies. HR teams would have very little time to manage layoffs and paperwork for foreign staff.
The rule would not stop at H-1B visas. It would also affect L-1, O-1, TN, E-1, E-2, E-3, and H-1B1 visa holders from several countries.
This includes specialty workers from Australia, Singapore, and Chile, along with international managers and people with extraordinary skills in science, sports, or arts.
Before this rule becomes official, the public will get two months to share their opinions and concerns.
Many experts believe this move is part of a bigger effort to reduce legal immigration levels across the United States.
If passed, this rule could change how top American companies plan their hiring and manage global talent in the future.
