“A Shield for the Pen — Senate Passes Journalist Protection Bill Unanimously”

In a rare and remarkable move, the Senate of Pakistan has unanimously passed the Journalist Protection (Amendment) Bill, marking a historic milestone for press freedom and journalist safety in the country. This is not just another piece of legislation — it’s a legal recognition of the countless sacrifices made by truth-seeking journalists, and a bold step towards safeguarding the sanctity of free expression.

The Spirit of the Bill

At its core, the bill affirms that freedom of expression includes the right to publish and disseminate information. It provides a protective legal framework for journalists, their families, and close associates — shielding them from threats, violence, coercion, or obstruction in the line of duty.

Under the bill, violence against a journalist during duty will be punishable with up to 7 years of imprisonment and a fine of PKR 300,000. Forpressuring a journalist to reveal sources, the offender may face 3 years in jail and a fine of PKR 100,000. Similarly, any attempt to hinder a journalist’s professional independence could result in 5 years of imprisonment and a fine.

Extending Protection to Families

Unlike many similar laws globally, this bill also protects the journalist’s spouse, dependents, colleagues, and close relatives, recognizing that threats often extend beyond the individual. It ensures their physical, psychological, and social security under the law.

Commission for Journalist Protection

A dedicated Journalist Protection Commission will be established under the bill. The Chairperson must be a retired High Court judge or an individual eligible for such a position, with at least 15 years of experience in human rights and media-related legal practices.
The commission is empowered to:

Ensure safety of journalists and media workers under threat

Protect journalists’ properties, belongings, media groups, and social movements

Direct the police to file FIRs based on complaints it receives

Maintain the confidentiality of complainants’ identities

Recommend protection measures in cases of credible threats

However, the bill clearly states that the commission cannot directly investigate intelligence agency actions. If any complaint involves alleged violations of human rights by intelligence agencies, the matter will be referred to the relevant authority.

Special Courts and Swift Justice

In another landmark provision, the bill mandates the establishment of special courts for the expeditious trial of cases involving crimes against journalists. These courts will be set up in consultation with Chief Justices of the respective High Courts and the federal government. This ensures that cases are heard with the urgency and seriousness they deserve.

Political Unity for Press Freedom

Perhaps the most encouraging aspect of this development is the unanimous support it received across the political spectrum. At a time when divisiveness defines much of our political climate, this collective agreement reaffirms that press freedom and journalist safety are national imperatives — not partisan issues.

This bill, if implemented earnestly, could usher in a new era of dignity, safety, and independence for Pakistani journalists. It is a legislative tribute to those brave men and women who stood tall against censorship, intimidation, and violence — and a message to future journalists that the State now stands beside their pen, not against it.
