Directive Aims to Enhance Handling of Cases Challenging Legal Statutes and Constitutional Interpretation
Islamabad-(Mudassar Iqbal): Newly appointed Chief Justice Yahya Afridi announced that he has directed the Supreme Court Registrar to transfer cases requiring constitutional interpretation to the Supreme Court’s Constitutional Bench.
This initiative aims to improve the management of cases that contest legal statutes and interpret constitutional clauses.
In a recent hearing, Justice Shahid Waheed stressed the importance of referring the Haq Shifa case to the Constitutional Bench in Islamabad, noting the need for careful interpretation of the constitutional provisions involved.
Chief Justice Afridi has instructed the Registrar’s Office to create a separate category for cases that challenge any legislation, ensuring that those needing constitutional interpretation are systematically transferred alongside related matters.
A three-member bench headed by Chief Justice Afridi presided over the case, demonstrating the court’s proactive stance on constitutional issues.
This policy follows the recent transfer of four cases to the Constitutional Bench, emphasizing a heightened focus on interpreting laws and constitutional provisions within the Supreme Court.
